Правова природа володіння

Abstract

Стаття присвячена характеристиці правової природи володіння як речового права. Розкрито зміст поняття володіння та обгрунтовано речово-правовий характер правовідносин володіння. Проаналізовано володіння знахідкою та бездоглядною домашньою твариною в контексті розмежування цих понять з категорією права на чужі речі, зокрема володіння. Ключові слова: право володіння, речове право, право на чуже майно, недобросовісний володілець, знахідка, бездоглядна домашня тварина.

The article is devoted to the characterization of the legal nature of possess right as a property right. It is disclosured the concept of possess right and reasonabled proprietary legal nature of possess right. It is analyzed possession finding and neglected homeless pet in the context distinction between the concepts of the category of the right to other people’s things, including possess right.
