Арбітрабельність спорів за участі споживачів товарів і послуг

Abstract

Стаття присвячена дослідженню питання можливості встановлення арбітрабельності споживчих спорів. Виходячи з характеру споживчих правовідносин, а також ураховуючи закордонний досвід установлення підвідомчості третейському судові певних категорій спорів, пропонується законодавче закріплення арбітрабельності споживчих спорів як додаткового інструменту захисту слабкої сторони у правовідносинах. The present article is concerned with studying the possibility of establishing the arbitrability of consumer disputes. Considering the nature of consumer relations and foreign practices of assigning certain case categories to the jurisdiction of arbitration courts, the author suggests providing legislative consolidation of arbitrability of consumer disputes as an additional tool designed for protecting the weaker party. Said consolidation shall be followed by additional protection for consumer against imposing the arbitration agreement by including it into typical and public agreements that cannot be amended by the consumer.
