Поступ професійної освіти та підготовки арбітражних юристів у розрізі історичного розвитку міжнародного арбітражу: досвід зарубіжних країн

Abstract

У статті вивчається, описується та узагальнюється поступ професійної освіти та підготовки арбітражних юристів у розрізі історичного розвитку міжнародного арбітражу в зарубіжних країнах. Прослідковуючи ґенезу міжнародного арбітражу, автор приходить до висновку, що попит на висококваліфікованих спеціалістів – арбітражних юристів продовжує невпинно зростати. Функціонування магістерських програм за спеціальністю «Міжнародний арбітраж» / «Альтернативні способи вирішення спорів» в провідних юридичних ВНЗ світу забезпечує потребу у таких фахівцях. In this article the author analyses historical development of arbitration and admits its current popularization as an alternative to traditional justice, consensually based on the agreement of the parties, and leading to a final and binding decision. Many factors contribute to the spread of international arbitration in the last decades what, to the greatest extent, can be explained by the growth of globalization processes in the sphere of trade and commerce. Many scholars have researched the historical aspects of the formation of international arbitration, but an important question of the retrospective survey of the professional training of specialists in this area is considered only briefly. From the outset businessmen, lawyers, economists, and scientists were involved in the work of different arbitration institutions, creating a new “prestigious” image of this domain. In the mid 1980s a question of professional training of specialists, able to conduct arbitration practice efficiently and effectively was treated with renewed vigour. For example, the American Bar Association created a special group with the mission to analyze current state of legal education in the United States and identify the necessity to teach courses on alternative methods of conflict resolution in higher educational institutions. As a result, a MacCrate Report was prepared, where it was firstly substantiated the need to introduce alternative procedures and other relevant disciplines in higher legal education as a part of professional training of future arbitration lawyers.
