| Abstract: | У статті аналізується спільний заповіт подружжя, його інституційна ефективність, теоретичні та практичні пере- шкоди до його застосування в цивільному обігу. Досліджено позиції науковців щодо природи спільного заповіту, його особливостей і причин законодавчого закріплення. Обґрунтована доцільність його подальшого дослідження для оцінювання ефективності його застосування й напрямів удосконалення. | Description: | The article is devoted investigation of common testament of the married couples, its institutional efficiency, theoretical and practical obstacles to its application in civil turnover. Positions of scientists are investigational in relation to nature of common general testament, its features and reasons of the legislative fixing. Author makes a conclusion about reasonable expediency its further research for the further estimation of efficiency of its application and directions of perfection. Key words: inheritance, married couples, common testament, part, common property. |
