The administrative appeal proceeding of power authority subjects' actions: experience of Ukraine and foreign countries

Abstract

The article discloses the procedure for appealing decisions, actions and inaction of the power authorities' subjects in Ukraine and in foreign countries, the European experienceis studing there in order to implement it in domestic legislation. The authors discuss such problems as the lack of substantive work on this topic; the violation of the rights of individuals and legal entities by subjects of authority;it is generated appeals to courts in the form of administrative proceedings. Based on the analysis of Ukrainian legislation, the authors come to the conclusion that the important issue of the present is not only the adoption of new legislation, but also its effective implementation in practice. In connection with the desire of Ukraine to become the full member of the European Union, the implementation of positive international experience in the current legislation is the important task for our state.
