Природно-правова і позитивістська школи права: порівняльний аналіз основних позицій.

Abstract

Стаття присвячена з’ясуванню характерних рис, притаманних ідеям природно-правової і позитивістської шкіл права, здійсненню їх порівняльного аналізу та виокремленню позитивних аспектів і недоліків, властивих даним школам права. Загалом, актуальність обраної теми дослідження зумовлена необхідністю використання у процесі розкриття природи права цінних досягнень широкого кола правових шкіл, які дають можливість сформувати всебічне уявлення про це складне й унікальне явище.

The article is devoted to the clarification of the characteristic features inherent in the ideas of the natural and positivist schools of law, the implementation of their comparative analysis and the isolation of the positive aspects and disadvantages inherent in these schools of law. In general, the relevance of the chosen topic is determined by the need to use the valuable achievements of a wide range of legal schools in the process of disclosing the nature of the law, which make it possible to form a comprehensive idea of this complex and unique phenomenon.
