Філософське дослідження злочину в контексті вивчення об’єкта та суб’єкта злочинності

Abstract

У статті визначено поняття об’єктивної сторони злочину, що включає діяльність або бездіяльність, спрямовану на завдання шкоди тому чи іншому об’єкту, інакше кажучи, це зовнішній акт зазіхання на об’єкт, що перебуває під охороною кримінального права. Необхідність правильного визначення питан- ня про об’єкт злочину має вагоме теоретичне та практичне значення. Ключові слова: злочин, злочинність, суспільство, філософія права об’єкта, філософія права суб’єкта.

To study the problem of crime in the perspective of socio-cultural environment it is important to investigate the attitude of the main components of this process, which is expressed in the categories of subject and object. The concept of the objective side of a crime includes the activity or omission aimed at causing harm to this or that object, in other words, it is an external act on the object protected by criminal law.
