ПРО ДОБІР КАНДИДАТІВ НА ПОСАДУ ПРОФЕСІЙНОГО СУДДІ ВПЕРШЕ (ОРГАНІЗАЦІЙНО-ПРАВОВІ ПРОБЛЕМИ)

Abstract

У статті розглянуто актуальні проблеми добору кандидатів на посаду професійного судді відповідно до європейських стандартів. Автор доходить висновку про те, що у зв’язку з тим, що розпочала свою роботу Конституційна Асамблея, варто передбачити відповідні зміни у тексті Конституції України, щоб уникнути положень, які суперечать європейським стандартам у сфері добору суддів, переглянувши, зокрема, і положення про Вищу раду юстиції. Також автор наголошує на необхідності перегляду поточного законодавства, що зробить прозорими процедури першого призначення суддів.

In article actual problems of selection of candidates for a position of the judge according to the European standards are considered. The author comes to a conclusion that because there began the work the Constitutional Assembly, it is necessary to provide corresponding changes in the text of the Constitution of Ukraine for elimination of the provisions contradicting the European standards in the sphere of selection of judges, having reconsidered, in particular, and the provision on the Supreme council of justice. Also the author places emphasis on need of revision of the current legislation that will make transparent procedures of initial appointment of judges.
