Житлові права та обов’язки громадян: проблеми теорії та практики

Abstract

У даній статті проаналізовано взаємозв’язок між правом особи на житло та обов’язком інших фізичних, юридичних осіб, державних органів щодо створення відповідних умов, для здійснення охорони, захисту та реалізації цього права. Адже потреба людини у житлі виникає з моменту її народження, зберігається протягом усього життя і припиняється після смерті. Також наведено погляди вченихправників на проблему забезпечення людини житлом, здійснення захисту права на недоторканність житла та обмеження такого права. Проаналізовано шляхи та причини виникнення проблеми незабезпечення людей житлом, втрати останніми житла, а також зазначено про вагомість впливу громадянської думки на вирішення зазначених проблемних питань

This article analyzes the relationship between the human right to housing, and the responsibility of other individuals, legal entities, state agencies to create appropriate conditions for the implementation of conservation, protection and realization of this right. After all, the person needes for shelter there from the moment of her birth, remains for life and ends in death. We also present the views of legal experts on the problem of providing people with housing, protection of the right to privacy of the home and limits of the right. This article also analyzes the ways and reasons for failure of people’s housing problems, the loss of there housing and also indicated an important influence on the civil thoughts to solve these problematic issues.
