Судебный конституционный нормоконтроль в Российской Федерации в уголовно–процессуальной сфере

Abstract

У статті аналізується практика Конституційного Суду Російської Федерації у справах про конституційність положень російського кримінально-процесуального законодавства. Особливе місце відведено вивченню питань про роль рішень Конституційного Суду Російської Федерації в системі джерел права і правотворчої функції Конституційного Суду Російської Федерації. Автор не тільки наводить статистичні дані та приклади з конституційної практики, а й акцентує увагу на механізмі виконання окремих рішень Конституційного Суду Російської Федерації в кримінально-процесуальній сфері.

The article examines the practice of the Constitutional Court of the Russian Federation regarding the constitutionality of the provisions of the Russian legislation on criminal procedure. A special place is given to the study of issues about the role of the Constitutional Court of the Russian Federation in the system of sources of law and law-making powers of the Constitutional Court of the Russian Federation. The author not only gives statistics and examples from the constitutional practice, but also focuses on the mechanism of execution of certain decisions of the Constitutional Court of the Russian Federation in the field of criminal procedure.
