ПРАВОВЕ РЕГУЛЮВАННЯ ВИБОРЧОГО ПРАВА ВІЙСЬКОСЛУЖБОВЦІВ ЧЕРЕЗ ПРИЗМУ НАЦІОНАЛЬНОГО ТА ЗАРУБІЖНОГО ЗАКОНОДАВСТВА

Abstract

Стаття присвячена висвітленню особливостей реалізації та захисту виборчого права військовослужбовців через призму чинного національного законодавства, а також історичного розвитку виборчого права на теренах Української держави та за- конодавства різних країн світу. Загалом у роботі здійснюється аналіз законодавства держав світу, яке регулює конституційне право громадян обирати та бути обраним, у тому числі право військовослужбовців. У висновках подані логічні заключення сто- совно обмежень військовослужбовців у здійсненні їхнього конституційного активного та пасивного виборчого права з огляду на проведений аналіз законодавства різних держав, у тому числі й українського. Ключові слова: військовослужбовці, конституційне право, активне виборче право, пасивне виборче право, військова служба, урядова криза, конституційний конфлікт, ситуація «співіснування», державний переворот.

This article is devoted to highlighting the peculiarities of the implementation and protection of the electoral rights of military personnel through the prism of the current national legislation, as well as the historical development of electoral law (suffrage) on the territory of the Ukrainian state and legislation of different countries of the world. In general, the analysis of the legislation of different countries of the world is carried out, which regulates the constitutional right of citizens to elect and to be elected, including the right of military personnel. Final part contains logical conclusions regarding the restrictions of military personnel in the implementation of their constitutional active and passive suffrage, taking into account the analysis of legislation of different countries, including Ukrainian ones.
