Abstract: У статті розглянуто основні історичні етапи становлення конституціоналізму як багатогранного правового явища, яке бере свій початок з часів античності. Ідеї кон- ституціоналізму можливо побачити у висловлюваннях таких відомих філософів, як Аристотель, Платон та Демокріт. Зазвичай вони стосуються норм співжиття, понять рівності та справедливості, гуманності. У працях цих вчених зародилися ті підва- лини, які у сучасному розумінні набули особливої цінності. Проаналізовано осно- воположні документи, що закріпили принципи права та стали першими витоками конституціоналізму у світі. Зокрема, Велика Хартія Вольностей 1215 року, яку також іменують першою «неписаною Конституцією» Англії, декларувала гарантії від неза- конного затримання та ув’язнення, дотримання справедливої та належної юридичної процедури, збереження права на майно. Також певні свободи отримала церква, як- от можливість самостійного вибору єпископа. Були закладені поняття міграційних процесів та вільного пересування людини. Цей документ у правовому значенні став наріжним каменем у європейському конституційному процесі та втілив у життя світо- глядні ідеї прав людини. Ще одним каталізатором змін стала Славна Революція, яка закінчилась прийняттям Білля про права, що став одним із перших документів, який захищав особисті права громадян. Проаналізовано ці історичні періоди та присвя- чено увагу радянській Конституції та її значенню в становленні конституціоналізму. Констатовано, що у сучасному глобалізованому світі конституціоналізм неможливо розглядати ізольовано, адже в побудові правової держави неминучим є взаємодія усіх юридичних інститутів задля реалізації верховенства права та досягнення розви- нутого громадянського суспільства із високим дотриманням прав людини.
The article deals with the basic historical stages of constitutionalism as a multifaceted legal phenomenon that dates back to antiquity, where it is possible to trace such ideas to the statements of famous philosophers such as Aristotle, Plato, and Democritus in norms of coexistence, equality and justice, that their works are seen to be the origin of those foundations that have acquired special value in the modern sense. The basic documents that consolidate the principles of law and become the first sources of constitutionalism in the world are analyzed – the Great Charter of Liberties in 1215, which is also called the first “unwritten Constitution” of England, which declared guarantees to a person against illegal detention and imprisonment and due process of justice, the preservation of the right to property, as well as certain freedoms were given to the church, as an opportunity to choose a bishop independently. The concepts of migration processes and free movement of person were laid. This document legally laid the cornerstones of the European consti- tutional process and brought to life the ideas of human rights. Another catalyst for change was the Glorious Revolution, which ended with the adoption of the Bill of Rights, which became one of the first documents to protect the personal rights of citizens. The follow- ing historical periods are analyzed and attention is paid to the Soviet Constitution and its significance in the establishment of constitutionalism. In the modern globalized world, it is stated that constitutionalism cannot be considered in isolation, since in the construction of the rule of law it is inevitable that all legal institutions interact in order to realize the rule of law and achieve a developed civil society with high respect for human rights.
