Abstract: Сучасні наукові досягнення надали майбутнім батькам, серед іншого, можливість, яка не існувала до цього часу – впливати на якісні характеристики потенційної ди- тини. Зазначене поширюється на можливості впливу як на клітинному, так і генному рівнях. У цій статті розглядається один з видів біоінженерії – клітинна біоінженерія, що дозволяє на клітинному рівні здійснити втручання у біологічну природу майбут- ньої людини та потенційної дитини. Зазначено про види клітинної біоінженерії, що полягають у можливості створення клонів, химер та гібридів. Розкрито з юридичного погляду типи та суть клонування. Зазначено, що воно може бути репродуктивним і мати на меті створення нової (клонованої) людини, а також терапевтичне клону- вання, яке застосовується у медичних цілях. Вказано на особливості міжнародно- го та національного регулювання цих типів клонування та відсутність консенсусу із дискусійних питань. Наведено аргументи на користь використання та заборони репродуктивного і терапевтичного клонування. Підкреслено, що заборона на ство- рення химер і гібридів з людським репродуктивним матеріалом має бути абсолют- ною. Обґрунтовано, що репродуктивне клонування можливе лише за таких умов: має бути науково доведено безпечність методики клонування людини; право на ре- продуктивне клонування мають винятково батьки з метою продовження свого роду; дозволяється відтворити шляхом клонування не більше одного нащадка. Зроблено висновок, що на сучасному етапі деякі біотехнології наразі взагалі передчасно засто- совувати до людини, насамперед ті, які спрямовані на репродуктивне відтворення, зокрема репродуктивне клонування, а ті з них, які мають терапевтичну мету, – тіль- ки у частині використання індивідуальних препаратів для конкретних пацієнтів, для яких це єдина реальна можливість запобігти захворюванням чи їх усунути, у тому числі для потенційних дітей
Modern scientific advances have given future parents, among other things, an oppor- tunity that did not exist until now – to influence the qualitative characteristics of a potential child. This applies to both cellular and gene levels. This article examines one type of bio- engineering – cellular bioengineering, which allows the cellular level to interfere with the biological nature of the future human and potential child. The types of cellular bioengineer- ing, which include the ability to create clones, chimeras and hybrids, are noted. The types and nature of cloning have been legally disclosed. It has been stated that it can be reproductive and aiming at the creation of a new (cloned) person, as well as therapeutic cloning used for medical purpos- es. The peculiarities of international and national regulation of these types of cloning and the lack of consensus on discussion issues are pointed out. Arguments in favor of the use and prohibition of reproductive and therapeutic cloning are presented. It is emphasized that the ban on the creation of chimeras and hybrids with human reproductive material should be absolute. It is substantiated that reproductive cloning is possible only under the following conditions: the safety of the human cloning technique must be scientifically proven; only parents have the right to reproductive cloning for the purpose of continuing their family; no more than one offspring can be reproduced by cloning. It is concluded that, at the present stage, some biotechnologies are now generally prematurely applied to humans, primarily aimed at reproductive reproduction, in particular reproductive cloning, and those that have a therapeutic purpose only in the use of individual drugs for specific patients for which these are specific patients a real opportunity to prevent or eliminate the disease, including for potential children.
