КЛАСИФІКАЦІЯ ГАРАНТІЙ ЗДІЙСНЕННЯ ДЕРЖАВНОЇ ВЛАДИ В УКРАЇНІ

Abstract

В українській юридичній науці сьогодні не існує єдиної думки щодо класифікації гарантій державної влади та виділення певних критеріїв такої класифікації. У статті автором опрацьовано значний обсяг матеріалу, на основі такого аналізу запропоно- вано систему гарантій державної влади класифікувати на загальні, що забезпечують функціонування та розвиток суспільства, та юридичні, які закріплені у нормативно- правових актах і встановлюють права та обов’язки суб’єктів правовідносин у сфері здійснення державної влади, а також закладають механізм їхньої відповідальності, матеріально-фінансові та кадрові засади функціонування. З’ясовано, що система гарантій державної влади є складною й чітко невизначеною, а тому вимагає подаль- шого наукового дослідження, адже гарантії – це передумови існування ефективної системи державної влади. Здійснено розгляд гарантій державної влади з позицій системного підходу. Ключові слова: державна влада, народовладдя, гарантії здійснення державної влади, органи державної влади, демократія.

In Ukrainian legal science today there is no unanimity about the classification of government guarantees and the allocation of certain criteria for such a classification. In this article the author has processed a considerable amount of material, on the basis of such an analysis, it is proposed to classify the system of state guarantees to the general, ensuring the functioning and development of society and legal, which are enshrined in the legal acts and establish the rights and obligations of the subjects of legal relations in the sphere of implementation of state power, and also lay the mechanism of their responsibility, material and financial and personnel principles of functioning. It is revealed that the system of guarantees of state power is complex and clearly uncertain, and therefore – requires further scientific research, since guarantees are prerequisites for the existence of an effective system of state power. The consideration of state power guarantees from the point of view of the system approach.
