ФЕДЕРАТИВНЫЕ ОТНОШЕНИЯ МЕЖДУ РИМЛЯНАМИ И ВАРВАРАМИ ЭПОХИ ДОМИНАТА (284–480 ГГ.): ИСТОРИКО-КОНСТИТУЦИОННЫЙ И МЕЖДУНАРОДНО-ПРАВОВОЙ АНАЛИЗ

Abstract

Статья посвящена конституционному и международно-правовому анализу исто- рического феномена lex foedus. Автор рассматривает позднеримскую политическую действительность (476-480 гг.) как отсутствие политической целостности государ- ства. Сделан вывод, что нарушение централизованного механизма римской госу- дарственности состоялось из-за возрождения и федералистской интерпретации в Западной Римской империи (395-480 гг.) республиканской практики федеративных взаимоотношений с «заграничными союзниками» (варварами). The article is devoted to the constitutional and international legal analysis of the historical phenomenon of lex foedus. The author considers the late Roman political reality (476-480) as the absence of the political integrity of the state. It was concluded that the violation of the centralized mechanism of the Roman statehood was due to the revival and federalist interpretation in the Western Roman Empire (395-480) the republican practice of federal relations with “foreign allies” (barbarians).
