ОБМЕЖЕННЯ ПРАВА НА ОБ’ЄДНАННЯ У ПРОФЕСІЙНІ СПІЛКИ В УКРАЇНІ ТА ОКРЕМИХ КРАЇНАХ ЄВРОПЕЙСЬКОГО СОЮЗУ: ПОРІВНЯЛЬНИЙ АНАЛІЗ

Abstract

Стаття присвячена вивченню проблематики конституційно-правового регулюван- ня обмеження права на об’єднання у професійні спілки. Проводиться порівняльне дослідження особливостей такого обмеження в Україні та окремих країнах Європей- ського Союзу. Аналізується доцільність та необхідність закріплення окремих видів обмежень цього права в законодавстві. Ключові слова: професійні спілки, права людини, право на об’єднання, право на об’єднання в професійні спілки, обмеження прав, обмеження права на об’єднання у професійні спілки.

The article focuses on exploring issues relating to the constitutional and legal regulation of the restriction on the right to form and join trade unions. It carries out a comparative study into the peculiarities of such restriction in Ukraine and in some EU member countries. The article also examines the feasibility and necessity of the establishment of some types of restriction on this right on the legislative level.
