КОПНЕ СУДОЧИНСТВО В УКРАЇНІ ТА ОСОБЛИВОСТІ ЙОГО ЗДІЙСНЕННЯ

Abstract

Удосконалення процесуальних галузей законодавства має на меті створен- ня оптимальних умов для максимального захисту прав, свобод, законних інтер- есів особи. Сучасна Українська держава намагається досягти цієї мети шляхом здійснення судово-правової реформи. Ефективність таких заходів зростатиме за умови належного застосування національного правового досвіду. У зазначе- ному контексті набуває актуальності дослідження функціонування судової сис- теми на етнічній території України в минулі епохи, зокрема, суть і особливості здійснення копного судочинства на українських землях у ХІV – ХVІ ст.

Procedural law’s improvement creates sufficient conditions for the highest level of protection of rights, freedoms and legitimate interests of an individual, which is an important aspect of a constitutional state. Modern Ukrainian state is trying reach this criteria by implementation of judicial reform. Efficiency of such process will begetting higher with a consideration of national legal experience. Persegreat significance is dedicated to investigations of judiciary’s functioning on Ukrainian land sin last centuries, in particular, the research on the essence and peculiarities of the application of Kopa’s jurisdiction on the territory of Ukraine during XIV – XVI centuries.
