Abstract

У статті проаналізовано питання прав і свобод людини та громадянина в ци- вілізованому суспільстві, де особа стоїть на першому місці серед всіх суспільних цінностей, але не як об’єкт піклування з боку держави, позбавлений самостійнос- ті, а як суб’єкт, наділений реальними правами і можливостями. Саме стан справ у сфері прав особи, їх практичної реалізації є тим критерієм, за яким оцінюється рівень демократичного розвитку будь-якої держави і суспільства загалом. Права і свободи людини та громадянина повинні визнаватися і гарантуватися держа- вою в обсязі загальновизнаних міжнародних стандартів.

The article analyzes the questions of the rights and freedoms of man and citizen in a civilized society, where the personality is in first place among all social values, but not as an object of care from the state, deprived of independence, and as a subject, endowed with real rights and opportunities. It is the state of Affairs in the field of human rights, their practical implementation is the criterion used to assess the level of democratic development of any state and society as a whole. The rights and freedoms of man and citizen are recognized and guaranteed by the state in the amount of internationally recognized standards.
