ПОНЯТТЯ Й ОСНОВНІ ОЗНАКИ ПРАВА НА СПРОТИВ: ТЕОРЕТИКО-ПРАВОВИЙ АСПЕКТ

Abstract

У статті досліджуються наукові підходи до визначення поняття «права на спротив» і суміжних термінів, аналізуються погляди різних авторів на цю проблематику та нормативне закріплення поняття «права на спротив». Узагальнюються наукові підходи до визначення досліджуваного поняття, виокремлюються його ознаки, на підставі чого пропонується авторське визначення цього терміна.

The article investigates scientific approaches to the definition of the concept of “the right to resistance” and certain adjacent terms, analyzes the views of different authors on this issue and the normative attachment of the concept of “the right to resistance”. Generalized scientific approaches to the definition of the concept under study, its features are distinguished, on the basis of which the author’s definition of this term is proposed.
