ПРАВО ОСОБИ НА ОХОРОНУ ЗДОРОВ’Я: ГНОСЕОЛОГІЧНІ ПІДХОДИ

Abstract

Статтю присвячено висвітленню гносеологічних аспектів конституційного права особи на охорону здоров’я. Досліджено різні концептуальні підходи до розуміння поняття та змісту права особи на охорону здоров’я; проведено аналіз широкого та вузького підходів до визначення змісту цього права; встановлено його структуру й обсяг; з’ясовано зміст ключових понять у цій сфері. Обґрунтовано доцільність застосування широкого підходу до розуміння змісту конституційного права особи на охорону здоров’я; запропоновано його авторське визначення.

The article is devoted to the coverage of epistemological aspects of the constitutional right of a person to health care. Different conceptual approaches to the understanding of the notion and content of the person’s right to health care are investigated; аnalysis of wide and narrow approaches to the definition of the content of this right; its structure and volume are determined; the content of other key concepts in this area is elucidated. The expediency of applying a broad approach to understanding the content of the constitutional right of a person to health protection has been substantiated; author’s definition of this right is proposed.
