КОНСТИТУЦІЙНІ РЕФОРМИ В ЛАТИНСЬКІЙ АМЕРИЦІ КРІЗЬ ПРИЗМУ НЕОКОНСТИТУЦІОНАЛІЗМУ

Abstract

Стаття присвячена аналізу конституційних реформ у країнах Латинської Америки кінця ХХ – початку ХХІ ст., ідейно-теоретичний базис яких становлять настанови латиноамериканського варіанта сучасного неоконституціоналізму. Особливий наголос робиться на визнанні колективних прав корінних народів і закріпленні національного та юридичного плюралізму.

The article is devoted to the analysis of constitutional reforms in the countries of Latin America of the late 20th and early 21st centuries, whose ideological and theoretical basis was the guideline of the Latin American variant of modern neo-constitutionalism. Particular emphasis is placed on the recognition of the collective rights of indigenous peoples and the consolidation of national and legal pluralism.
