ГАРАНТІЇ КОНСТИТУЦІЙНИХ ОБОВ’ЯЗКІВ ДЕРЖАВИ: ПРОБЛЕМИ ВИЗНАЧЕННЯ ПОНЯТТЯ

Abstract

Статтю присвячено дослідженню поняття «гарантії конституційних обов’язків держави», з’ясуванню сутності, змісту і форм таких гарантій. Зроблено висновок, що гарантії конституційних обов’язків держави становлять визначену конституцією і законами держави, міжнародними правовими актами систему засобів, способів, умов і механізмів, необхідних для безперешкодної і невідворотної реалізації державою своїх конституційних обов’язків, унаслідок чого належне перетворюється в реальну дійсність. Виявлена моністична сутність гарантій конституційних обов’язків держави, що полягає в забезпеченні невідворотності реалізації державою своїх конституційних обов’язків. З’ясовано, що формалізація змісту гарантій конституційних обов’язків держави може мати різний вияв, яким є: невтручання, утримання, забезпечення, подолання, охорона, примус.

The article is devoted to the study of the concept of «guaranteeing the constitutional duties of the state», clarifying the essence, content and forms of such guarantees. The conclusion is made that the system of means, methods, conditions and mechanisms necessary for the unimpeded and unavoidable realization by the state of its constitutional duties, as a result of which the due becomes a real reality, constitute the guarantees of the constitutional duties of the state, determined by the constitution and laws of the state, international legal acts. The monistic essence of guarantees of the constitutional duties of the state is found, which consists in ensuring the inevitability of the state's exercise of its constitutional duties. It has been clarified that the formalization of the content of guarantees of the constitutional duties of a state can have various manifestations, which include: non-intervention, abstention, security, overcoming, protection, coercion.
