УНІКАЛЬНЕ ДОСЛІДЖЕННЯ СУЧАСНОГО ЄВРОПЕЙСЬКОГО КОНСТИТУЦІОНАЛІЗМУ

Abstract

Стаття присвячена аналізу публікації підсумків унікального у європейському пра- ві дослідницького проєкту «Роль і майбутнє національних конституцій в європей- ському та глобальному управлінні» (2012–2018). Підкреслюється, що масштабне та систематичне дослідження порівняльного конституційного права дає змогу ви- значити сучасну європейську конституційну культуру та різноманітні елементи по- рівняльного європейського конституційного ландшафту і те, як на них вплинули чи змінили управління ЄС та глобальне управління. На відміну від загальноприйнятого в ЄС дискурсу враховувати вплив національних конституцій на формування кон- ституційного права ЄС, у тому числі через відстоювання принципу суверенітету, це дослідження робить акцент на тому, як ЄС і транснаціональне право вплинули на конституційну культуру в конкретних країнах, насамперед у таких сферах, як захист основних прав, гарантії верховенства права і конституційний контроль. У цьому пла- ні, на думку авторів статті, можна виділити три основні напрями критичного аналізу. По-перше, досліджується, як національні конституції відображають передачу по- вноважень від внутрішніх до європейських та глобальних інститутів (загальноєвро- пейський управлінсько-парадигмальний дискурс). По-друге, переглядаються осно- вні конституційні цінності, такі як захист конституційних прав, верховенство права, демократична участь і перегляд конституції, а також рішення конституційних судів і Суду ЄС, які стосуються захисту цих прав і цінностей у транснаціональному кон- тексті (загальноєвропейський аксіологічно-трансформаційний дискурс). По-третє, розглядаються проблеми у контексті глобального управління щодо судового нагля- ду, демократичного контролю та підзвітності (глобально-регіональний управлінсько-субординаційний дискурс). Окрему увагу авторами статті приділено характеристиці кризових явищ у національному конституціоналізмі ЄС та концепції кооперативного конституціоналізму, обґрунтованої керівником проєкту проф. А. Альбі (Albi). У під- сумку констатується, що опубліковані матеріали дослідницького проєкту ЄС задоку- ментували глибокі зміни в розвитку європейського конституціоналізму і забезпечили підґрунтя для подальшої наукової дискусії про майбутній розвиток національного, європейського та глобального конституціоналізму. The article is devoted to the analysis of the publication of the results of a unique research project in European law “The Role and Future of National Constitutions in European and Global Governance” (2012–2018). It is emphasized that a large-scale and systematic study of comparative constitutional law allows us to determine the modern European constitutional culture and the various elements of the comparative European constitutional landscape and how they have been influenced or changed by EU governance and global governance. In contrast to the common EU discourse to take into account the influence of national constitutions on the formation of EU constitutional law, including through the assertion of the principle of sovereignty, this study focuses on how the EU and transnational law have influenced the constitutional culture in particular countries, especially in such areas as protection of fundamental rights, guarantees of the rule of law and constitutional control. In this regard, according to the authors of the article, there are three main areas of critical analysis. First, it examines how national constitutions reflect the transfer of powers from internal to European and global institutions (pan-European governance and paradigm discourse). Secondly, fundamental constitutional values such as the protection of constitutional rights, the rule of law, democratic participation and revision of the constitution are reviewed, as well as decisions of the constitutional courts and the Court of Justice concerning the protection of these rights and values in a transnational context (pan-European axiological-transformational discourse). Third, issues in the context of global governance in judicial oversight, democratic scrutiny and accountability (global-regional governance-subordination discourse) are addressed. The authors of the article pay special attention to the characterization of the crisis in national constitutionalism of the EU and the concept of cooperative constitutionalism, justified by the project manager, Prof. A. Albi. As a result, it is stated that the published materials of the EU research project have documented profound changes in the development of European constitutionalism and provided the basis for further scientific discussion on the future development of national, European and global constitutionalism.
