ТЕОРЕТИКО-МЕТОДОЛОГІЧНІ ПРОБЛЕМИ НАУКОВИХ ДОСЛІДЖЕНЬ У СФЕРІ КОНСТИТУЦІЙНОГО ПРАВА НА СУЧАСНОМУ ЕТАПІ

Abstract

У статті проаналізовано методи дослідження конституційних явищ. Доведено, що дослідження основних категорій конституційного права, виявлення складових елементів, вирішення наявних проблемних питань, пов’язаних із застосуванням конституційних норм, вимагають формування відповідної методології. Обґрунтовано висновок про те, що під методами дослідження конституційних явищ варто розуміти систему фундаментальних ідей та принципів, які допомагають виявити юридичні особливості інститутів конституційного права та змоделювати перспективи його розвитку.

The methods of research of the constitutional phenomena are analyzed in the article. It is well-proven that research of basic categories of constitutional right, exposure of their component elements, decision of existent problem questions, constitutional norms related to application requires forming of corresponding methodology. There is reasonable a conclusion that under the methods of research the constitutional phenomena it costs to understand the system of fundamental ideas and principles that allow to find the legal features of institutes of constitutional law and model the prospects of his development.
