СУБСИДІАРНІСТЬ ЯК ПРИНЦИП КОНСТИТУЦІОНАЛІЗМУ

Abstract

У статті досліджуються перспективи практичної реалізації принципу субсидіарності в Україні в процесі муніципальної реформи. Досліджено основні нормативні акти, на підставі яких відбувається черговий етап цієї реформи, а також проекти законів щодо внесення змін і доповнень до Конституції України. Автор обстоює тезу про те, що увага, яка зараз приділяється закріпленню принципу субсидіарності в нормативних актах, є надмірною, адже ратифікація Україною низки європейських муніципальних стандартів, у яких закріплено цей принцип, вже включила його до національного законодавства. Проблемою залишається практична реалізація принципу субсидіарності в Україні як одного з принципів муніципального права.

The article deals with the prospects of practical implementation of the principle of subsidiarity in the Ukraine in the process of municipal reform. The basic regulations on which is the next stage of this reform, as well as draft laws on making amendments to the Constitution of Ukraine. The author defends the thesis to the effect that excessive attention that is now given to the consolidation of the subsidiarity principle in the regulations are unnecessary. After ratification by Ukraine Municipal number of European standards, which enshrined the principle already included it into national law. The problem is the practical realization of the principle of subsidiarity in Ukraine as one of the principles of municipal law.
