АДВОКАТУРА ЯК НЕВІД’ЄМНИЙ ІНСТИТУТ ГРОМАДЯНСЬКОГО СУСПІЛЬСТВА НА СУЧАСНОМУ ЕТАПІ СТАНОВЛЕННЯ ПРАВОВОЇ ДЕРЖАВИ В УКРАЇНІ

Abstract

У статті досліджуються місце і роль адвокатури в сучасній правовій системі України. Вказується на те, що Конституція України надає адвокатурі велике значення, перетворюючи її на ключову правозахисну інституцію та закріплюючи за нею функції щодо надання професійної правничої (правової) допомоги не тільки певним, конкретним особам, а й суспільству взагалі. Робиться висновок про те, що адвокатура є незалежним і невід’ємним інститутом громадянського суспільство, але вона жодним чином не повинна розглядатися як громадська організація.

In this paper, an analysis the place and role of the legal profession in the modern legal system of Ukraine. It is pointed out that the Constitution of Ukraine pays lawyers important role, transforming it into a key human rights organization, fixing her functions to provide professional legal assistance is not only certain, specific individuals, but also society as a whole. The conclusion is that the legal profession is independent and integral institution of civil society, but it should in no way be regarded as a social organization.
