ЮРИДИЧНИЙ МЕХАНІЗМ ПОСИЛЕННЯ СОЦІАЛЬНОГО ЗАХИСТУ УЧАСНИКІВ БОРОТЬБИ ЗА НЕЗАЛЕЖНІСТЬ УКРАЇНИ У XX СТОЛІТТІ

Abstract

У статті досліджено законодавство щодо правового статусу і соціальних гарантій учасників боротьби за незалежність України у ХХ столітті. Визначено основні недоліки і прогалини у чинному законодавстві, показано шляхи їх подолання. Визначено механізм організаційно-правового забезпечення соціального захисту колишніх вояків ОУН і УПА, а також інших збройних формувань. Показано особливості функціонування нового державного органу, що здійснює державну політику стосовно борців за незалежність України.

Legislation regarding legal status and social guarantees of the fighters for Ukraine’s independence in the XX century is reviewed in the paper. The main shortcomings and gaps in the current legislation are identified, the ways of overcoming them are shown. The mechanism of organizational and legal provision of social protection of former soldiers of the OUN and the UPA, as well as other armed groups, was determined. The features of the functioning of a new state body that pursues the state policy regarding the fighters for the independence of Ukraine are shown.
