ПОДІЛ ДЕРЖАВНОЇ ВЛАДИ ЯК КРИТЕРІЙ КЛАСИФІКАЦІЇ ФОРМ ДЕРЖАВНОГО ПРАВЛІННЯ

Abstract

Стаття присвячена аналізу теорії поділу державної влади як одного з основних критеріїв класифікації форм державного правління. Автором обґрунтовується позиція, що видові розходження між сучасними монархіями і республіками залежать від закріпленого конституцією й фактично створеного механізму формування взаємовідносин між законодавчою, виконавчою й судовою владою, тобто зумовлені моделлю поділу державної влади й відповідною системою стримувань і противаг, яка є визначальною для формування конкретної форми правління.

The article is devoted to the analys is of the theory of the division of state power as one of the main criteria for the classification of forms of government. The author substantiates the position that the distinctive differences between modern monarchies and republics depend on the established constitution and actually created mechanism for the formation of relations between the legislative, executive and judicial authorities, that is due to the model of division of state power and the corresponding system of checks and balances, which is crucial for the formation a specific form of government.
