ПРИНЦИПЫ ОБЪЕДИНЕНИЯ ТЕРРИТОРИАЛЬНОЙ ОБЩИНЫ КАК ОСНОВА КОНСТИТУЦИОННОСТИ ИХ СОЗДАНИЯ

Abstract

Статья посвящена исследованию понятия и системы принципов объединения территориальной общины как основы их конституционности. Автором поднимается проблема понимания природы правовых принципов, определяются их характерные признаки, исследуется роль и значение правовых принципов в системе правоприменительной деятельности. Разработано определение понятия принципов объединения территориальной общины, раскрывается содержание принципов объединения территориальной общины, определённых Законом Украины «О добровольном объединении территориальных общин», с учётом особенностей, присущих процессу объединения общин. Автором предложены идеи относительно усовершенствования системы исследуемых принципов путём нормативного закрепления более широкой их системы.

The article is devoted to the study of the concept and system of principles of the association of the territorial community as the basis of their constitutionality. The author raises the problem of understanding the nature of legal principles, determines their characteristic features, explores the role and importance of legal principles in the system of law enforcement activities. The definition of the concept of the principles of the unification of the territorial community is developed, the content of the principles for the unification of the territorial community, as defined by the Law of Ukraine “On the voluntary association of territorial communities”, is considered, taking into account the peculiarities inherent in the process of uniting communities. The author suggests ideas for improving the system of research principles by means of normative consolidation of their wider system.
