ВИНИКНЕННЯ І РОЗВИТОК ВЧЕННЯ ПРО ПУБЛІЧНИЙ ПОРЯДОК У АНГЛО-АМЕРИКАНСЬКІЙ ТА КОНТИНЕНТАЛЬНІЙ ПРАВОВИХ ТРАДИЦІЯХ

Abstract

У статті здійснюється аналіз сутності та загальних закономірностей виникнення та розвитку концепції публічного порядку в країнах англо-американської та континентальної правових систем. Розкриваються причинно-наслідкові зв’язки між різними джерелами, які впливали на розвиток концепції публічного порядку в Англії, Франції, Німеччині. Окрема увага приділяється судовій практиці як основному джерелу формування публічного порядку у вказаних країнах. Узагальнено особливості розвитку концепції публічного порядку та сформульовано відповідні висновки.

The article analyzes the essence and general patterns of the origin and development of the concept of public order in the countries of the Anglo-American and continental legal systems. The causal relationships between the various sources that influenced the development of the concept of public order in England, France, Germany are revealed. Particular attention is devoted to judicial practice as the main source of formation of public order in the specified countries. The generalization of the features of the development of the concept of public order is made and the corresponding conclusions are formulated.
