ЩОДО ПИТАННЯ ПРО УМОВИ ВИНИКНЕННЯ ЦИВІЛЬНО-ПРАВОВОЇ ВІДПОВІДАЛЬНОСТІ ЗА ЗАПОДІЯННЯ ШКОДИ ТЕРОРИСТИЧНИМ АКТОМ

Abstract

Стаття присвячена розкриттю умов виникнення цивільно-правової відповідальності за заподіяння шкоди внаслідок учинення терористичного акту. Аналізуються такі умови виникнення згаданої цивільно-правової відповідальності, як шкода, протиправне діяння, причинно-наслідковий зв’язок між протиправним діянням і шкодою й вина заподіювача шкоди (терориста). На основі вивчення чинного цивільного законодавства України зроблено висновок, що законодавець, дотримуючись одного з основоположних принципів цивільного права про відновлення порушеного права, покладає обов’язки з відшкодування шкоди й за відсутності деяких із досліджуваних умов.

The article is devoted to the disclosure of the conditions for the incurrence of civil liability for harm-doing as a result of a terrorist act. There are analyzed the following conditions of the incurrence of the mentioned civil responsibility, such as damage, wrongful act, cause-and-effect relationship between the wrongful act and the damage and the culpability of the harm-doer (the terrorist). In the article based on study of the current civil legislation of Ukraine there is concluded that the legislator following one of the fundamental principles of civil law for the restoration of a violated right, places the obligations of compensation for harm even in the absence of some of the investigated conditions.
