СОЦІАЛЬНІ ПРАВА У СИСТЕМІ ФУНДАМЕНТАЛЬНИХ ПРАВ ЛЮДИНИ

Abstract

The topic under study is relevant due to several points: firstly, at the beginning of the XXI century, human rights receive a new understanding: they are not merely subjective rights, they imply the legal guarantees that an individual is protected from encroachments on the part of governmental authorities, as well as other individuals; secondly, the thesis according to which social rights are “secondary” as against the so- called classical (personal and political) rights, should be re-considered, since they require active behavior on the part of the State and it is difficult to protect them in court.

Актуальність теми дослідження полягає у декількох моментах: по-перше, права людини на початку ХХІ ст. розуміються по-новому: це не прос- то суб’єктивні права, йдеться про правові гарантії захисту людини від посягань з боку як органів влади, так і інших осіб; по-друге, переосмисленню підлягає теза, що соціальні права є “другорядними” на тлі так званих класичних (особистих і політичних) прав, оскільки потребують активної поведінки з боку держави та складності їх судового захисту.
