КОНСТИТУЦІЙНА ДЕРЖАВА В ПОГЛЯДАХ Є.В. СПЕКТОРСЬКОГО

Abstract

У статті проаналізовано погляди відомого правознавця та громадського діяча першої половини ХХ ст. Є.В. Спекторського на дер- жаву та систему організації влади. Встановлено, що найбільш прийнятною формою держави, на його думку, є конституційна, оскільки в ній є рівновага між владою та суспільством. Населення такої держави повинно мати публічні права та політичні свободи, що, у свою чергу, перетворює їх із керованих підданих на самокерованих громадян. Порядок і свобода є цінними для кожної людини незалежно від її професії чи належності до партії. Вказано, що Є.В. Спекторський протиставляв конституційній державі самодержавні та псевдо- конституційні, які він піддавав критиці за обмеження або відсутність у них прав і свобод людини та громадянина. Важливим складником конституційної держави виступає конституція. Доведено, що Є.В. Спекторський визначав конституцію як організацію влади, яка є необ- хідною для всіх, подібно до просвітництва та інших культурних благ. Встановлений порядок функціонування влади, на його переконання, потрібен усім країнам без винятку, особливо постреволюційним державам для закріплення нових форм політичного життя та забезпечен- ня свободи населення. Досліджено погляди Є.В. Спекторського на зміст конституції, яка мала містити закони щодо організації публічної влади, а також закони про публічні права населення, які обмежують цю владу. Закони економічного характеру не мали бути включені до положень конституції, щоб її не ускладнювати. Метою конституції є забезпечення всіх правом на свободу пересування, слова, віри, участі в державних справах тощо. Визначено, що Є.В. Спекторський у своїх працях приділив увагу вивченню поняття «політична свобода». Він наводить окремі класифікації політичних свобод: громадянська та політична, негативна та позитивна. Хоча вище за всі політичні та еко- номічні свободи завжди буде стояти духовна, яка базується на християнстві. Крізь призму наявних у людини прав і свобод Є.В. Спектор- ский обґрунтовував можливість і необхідність участі громадян у формуванні державних органів влади як запоруку створення ідеальної організації влади в конституційній державі. In the article, the views on the state and system of organization of power, that belong to a famous jurist and public figure of the first half of the twentieth century, E.V. Spektorsky, have been analyzed. In his opinion, the most acceptable form of the state is found to be constitutional, since it has a balance between power and society. The population of such a state shall have public rights and political freedoms that, in turn, transform people from slave to self-governed citizens. Order and freedom are valuable to everyone, regardless of your profession or party affiliation. It is stated that E.V. Spektorsky opposed autocratic and pseudo constitutional states to the constitutional one; he criticized the first two for limiting or lacking the rights and freedoms of a man and citizen. An important component of a constitutional state is the constitution. It is proved that E.V. Spektorsky defined the constitution as an organization of power that is necessary for all in the same way as enlightenment and other cultural goods. In his point of view, the established order of functioning of the authorities is necessary for all countries without exception, especially for post-revolutionary states in order to consolidate new forms of political life and ensure the population’s freedom. The concepts of E.V. Spektorsky considering the constitutional content, which should consist of the laws on the organization of public power and the laws on the public rights restricting this power, have been examined. The laws of an economic nature should not be included in the constitutional provisions so as not to complicate them. The purpose of the constitution is to guarantee everyone the right to freedom of movement, speech, religion, participation in public affairs, and so on. It is determined that in his writings, E.V. Spektorsky paid attention to the study of the notion of “political freedom”. He listed the individual classifications of political freedoms: civil and political, negative and positive. Although, the spiritual freedom based on Christianity, is always superior to the political and economic ones. Through the prism of human rights and freedoms, E.V. Spektorsky substantiated the possibility and necessity of citizen’s participation in the formation of state bodies of power as the guarantee for the creation of an ideal organization of power in a constitutional state.
