ІНСТИТУТ ВІЙСЬКОВО-ЦИВІЛЬНИХ АДМІНІСТРАЦІЙ ТА ЙОГО ЗАПРОВАДЖЕННЯ В ЗОНІ ПРОВЕДЕННЯ АНТИТЕРОРИСТИЧНОЇ ОПЕРАЦІЇ

Abstract

Стаття присвячена аналізу доцільності та необхідності створення військово-цивільних адміністрацій на території зони проведення антитерористичної операції. Визначено основні повноваження та напрями діяльності таких органів. Зауважено деякі недоліки їхнього функціонування. Проблематика захисту цивільного населення під час збройного конфлікту на території України є одним із завдань сього- дення через сталу необхідність забезпечення належних умов для розвитку територій і сприяння в подоланні негативних наслідків й теро- ристичної загрози. Основним моментом, який потребував змін, було нормалізувати життя на території Луганської та Донецької областей шляхом налагодження ефективної та дієвої системи державного управління та системи місцевого самоврядування. Військово-цивільні адміністрації – це одна з ланок механізму держави, що наділена владними повноваженнями, має тимчасовий характер і бере важливу участь у виконанні функцій держави. При цьому ВЦА виконує функції, покладені на місцеві органи влади у разі їхньої відсутності для забезпечення безпечної життєдіяльності населення цих територій. Визначено головні ознаки, які характерні для військово-цивільних адміністрацій відповідно до норм чинного законодавства. Зауважено, що військово-цивільні адміністрації форму- ються з числа військовослужбовців військових формувань. Проаналізовано відповідне законодавство та визначено основні повноваження військово-цивільних адміністрацій. У свою чергу, окрім повноважень у сфері оборони, національної безпеки та цивільного захисту й забезпечення законності, правопорядку, охорони прав, свобод і законних інтересів громадян, – ВЦА мають повноваження у сфері планування й соціально-економічного розвитку та повно- важення у сфері бюджету й фінансів, управління майном. Зауважено, що деякі положення в чинному законодавстві потребують у багатьох аспектах більш чіткого узгодження з уже встанов- леними нормами через те, що військово-цивільні адміністрації мають спеціальне призначення – забезпечення дії Конституції та законів України. Інститут військово-цивільних адміністрацій розширив повноваження Президента України в сфері припинення повноважень сіль- ських, селищних, міських, районних, обласних рад та їхніх виконавчих органів, а також місцевих державних адміністрацій, змінив порядок призначення керівника районної та обласної військово-цивільної адміністрації. The article is devoted to the analysis of expediency and necessity of creation of military-civilian administrations in the territory of the area of anti-terrorist operation. The main powers and directions of activity of such bodies are determined. Some disadvantages of their functioning have been noted. The problem of protecting civilians during armed conflict in the territory of Ukraine is one of the tasks of today because of the constant need to provide the right conditions for the development of territories and to assist in overcoming the negative consequences and the terrorist threat. The main points that needed change were to normalize life in the Luhansk and Donetsk regions by establishing an effective and efficient system of state administration and local self-government. Civil-military administrations are one of the elements of the mechanism of the state, are temporary and take an important part in the performance of the functions of the state. In doing so, the CMA performs the functions assigned to local authorities in the absence of them to ensure the safe functioning of the population of these territories. The main features that are characteristic of civil-military administrations in accordance with the rules of the current legislation are identified. It is noted that civil-military administrations are formed from among military personnel of military formations. The relevant legislation is analyzed and the main powers of the military-civil administrations are determined. In addition to the powers in the field of defense, national security and civil protection and the protection of the rule of law, law enforcement, protection of rights, freedoms and legitimate interests of citizens, the CMA has the powers in the field of planning and socio-economic development and powers in the field of budget and finance, management property. It is noted that some provisions in the current legislation require in many respects a clearer harmonization with the already established norms, due to the fact that military-civil administrations have a special purpose – to ensure the operation of the Constitution and laws of Ukraine. The Institute of Military-Civil Administrations expanded the powers of the President of Ukraine in the field of termination of powers of village, settlement, city, district, regional councils and their executive bodies, as well as local state administrations, changed the procedure for appointing the head of district and regional military-civil administration.
