Abstract: Дисертація на здобуття наукового ступеня кандидата юридичних наук за спеціальністю 12.00.02 «Конституційне права; муніципальне право». – Ужгородський національний університет, Ужгород, 2020. Дисертаційне дослідження спрямоване на висвітлення теоретичних та практичних основ антропоцентризму суб’єктів публічної влади в історичному, емпіричному (практика сучасного державотворення), доктринальному, нормативному та теоретичному огляді конституціоналізму сучасних держав Центральної та Східної Європи (Франції, Чехії, Польщі та України). Тенденції розвитку держави сьогодні все частіше зводяться до закономірностей публічно‒правових та суспільно‒правових процесів, у котрих домінантну роль відіграють не правила взаємодії суб’єктів відносин, а власне самі суб’єкти та їхнє вміння використовувати правовий інструментарій. Конституціоналізм – у своїй основі складається із норм конституційного права та практики їх реалізації. Створення та ефективне здійснення цих елементів цілком залежить від людського потенціалу суб’єкта конституційних відносин. Правова регламентація застосування та врахування поведінкового елемента у процесі здійснення відносин дозволить позитивно впливати на розвиток державотворчих процесів. Проте для такої правової регламентації необхідним є належне теоретично‒правове та практичне обґрунтування сутності суб’єктів першу чергу публічної влади, що здійснено у цьому дослідженні.

Paradigm of the anthropocentrism of public authorities in the constitutionalism of the modern states of Central and Eastern Europe. – Qualifying scientific work on the rights of the manuscript. Thesis for the degree of Candidate of Law Sciences in specialty 12.00.02 “Constitutional Law; municipal law”. – Uzhhorod National University, Uzhhorod, 2020. The thesis research is aimed at clarifying the theoretical and practical foundations of the phenomenon of anthropocentrism of public authoritis in the constitutionalism of modern states of Central and Eastern Europe (France, the Czech Republic, Poland and Ukraine). By its structure, scientific work reveals the subject of study from historical, empirical, doctrinal, normative and derivative theoretical and practical points of view. The historical approach is revealed through an analysis of the views of various scholars and statesmen who influenced their decisions on the development of states and societies. Systematization of views allows distinguishing the abilities of rulers and officials, to determine the place of the person in the state mechanism, the importance of interest and interaction of the law with the subject of its implementation and influence. The empirical approach reflects the practice of implementing the rules of constitutional law based on the application of a human acting. The constitutional analysis of empirical facts is based on the participation of the authorities and their influence on the state processes of France, the Czech Republic, Poland and Ukraine. The doctrinal approach is aimed at exploring the views of modern scholars who comprehensively reveal the various facets of the subject of study. Special attention is paid to understanding of democracy in law, on the state and law as human phenomena, anthropocentric definition of the state, modern understanding of the place of the person in the state, their interaction, influence of the human acting on social and state processes, etc. The statutory review analyzes the constitutional rules of conduct set out in the constitutions of modern states of Central and Eastern Europe (France, the Czech Republic, Poland and Ukraine), which are anthropocentric in nature, that is, their implementation is impossible without the use of a human acting. These norms are constituent elements of the status of subjects of power. These include: safeguards, rights, discretionary powers, duties, prohibitions, restrictions, and the collective anthropocentrism, which is a set of legal instruments for making a common decision subject to the conscious participation of each subject, and the constitutional capacity, which plays a key role in the process of acquiring the status of a power entity. The theoretical approach of the study consists of two parts. The first presents the paradigm of anthropocentrism of public authorities, which reflects the processes of transition of anthropocentric phenomena from one form of manifestation (historical, empirical) to another (doctrinal and normative). The second part is devoted to defining the place and role of anthropocentrism of the subjects of power in modern constitutionalism, and to defining the concept of anthropocentrism in modern constitutionalism. The practical part reflects the application of the phenomenon of anthropocentrism, and thus – the improvement of the general theory of constitutional law, as well as the functioning of the state mechanism. Improvement of the general theory concerns: the methodology of constitutional law, the concept of the norm of constitutional law, the mechanism of its implementation, constitutional‒legal relations, their definition and structure, the status of the subject of public power, and more. Improving the functioning of the state mechanism is revealed through: the mandate of a parliamentarian, the requirements of constitutional capacity for the president and government officials, the improvement of the executive power system and the administration of justice. As a result of the conducted research, a number of conclusions are drawn, the main of which are the following: the place of anthropocentrism in relation to the constitutional order is determined by the third element between the social order and the state system, since it plays a key role in the implementation of both elements of the constitutional order; the place of anthropocentrism in relation to the construction of constitutional‒legal relations is reflected in the content of these relations, which consists of legal and material component. The legal component is the rights and obligations of subjects; the material component has external and internal elements. The external is the active action of the subject of the relationship, and the internal is the anthropocentric element embodied through a human acting, that is, knowledge, skills, abilities and experience of the individual. The role of anthropocentrism is reflected in the process of transition of the legal constitution to the actual one, because thanks to human potential, the formal definition of the rules of legal behavior becomes real application. The value of these results is that due to the theoretical definition of constitutional anthropocentrism in general, theoretical concepts of constitutional law receive new forms of expression and refinement, the construction of the state system acquires new tools that, which, when applied to individual mechanisms, relies on human potential, leading to a more effective exercise of powers and more effective state‒making decisions and norms (rights and discretionary powers) of constitutional law can take modified forms that, in a disposition, combine a measure of behavior with a particular form of human acting (regulated knowledge, skills or abilities).
