Abstract: Стаття присвячена вивченню проблемних питань функціональної неупередженості суду у випадках повторної участі судді у розгляді справи між сторонами в контексті п. 1 ст. 6 Конвенції про захист прав людини та основоположних свобод і принципу верховенства права. У статті автор звертає увагу на загальні підходи, вироблені у практиці Європейського суду з прав людини (далі – ЄСПЛ) до критеріїв оцінки неупередженості суду. Аналіз практики ЄСПЛ дає змогу виокремити суб’єктивну та об’єктивну неупередженість суду. Як додат- кові критерії виділяють функціональну та персональну неупередженість. Порушення функціональної неупередженості суду з погляду об’єктивного тесту можуть бути спричинені випадками повторної участі судді у розгляді справи між сторонами, серед яких розрізняють: а) повторне залучення судді до розгляду однієї і тієї ж справи між сторонами; б) повторне залучення судді до розгляду різних справ між тими ж сторонами, що можуть як бути, так і не бути пов’язаними між собою. Автором аналізуються підходи ЄСПЛ до визначення наявності або відсутності об’єктивних сумнівів у суддівській безсторонності в кожній із зазначених груп випадків. На підставі зазначеного робиться висновок про те, що абсолютною підставою для відводу судді визнається лише повторна участь судді, що розглядав справу в суді нижчої інстанції, під час розгляду справи в судах вищих інстанцій. Натомість усі інші ситуації, пов’язані з повторною участю судді в тій же справі, не свідчать автоматично про наявність упередженості суду та не виключають повторної участі судді у провадженні між сторонами. У таких ситуаціях для оцінки наявності обґрунтованих сумнівів в упередженості судді до уваги мають братися конкретні обставини справи. Крім того, ЄСПЛ знаходить порушення вимог неупередженості суду у випадках повторної участі судді у справах між тими самими сторонами, якщо такі справи пов’язані між собою, адже зазначені ситуації можуть викликати сумніви в неупередженості судді з боку стороннього спостерігача. The article is devoted to the study of problem issues of functional impartiality of the court in cases of repeated participation of the judge at the trial with the same parties in the context of par. 1 of Art. 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms and Rule of Law principle. In the article the author draws attention to the general approaches developed in the case law of the European Court of Human Rights (hereinafter – EctHR) to the criteria for assessing the impartiality of the court. An analysis of the ECtHR’s practice allows us to distinguish between the subjective and objective impartiality of the court. At the same time there is the additional criteria, which is the functional and personal impartiality of the court. Lack of functional impartiality of the court in terms of objective test may be caused by repeated participation of a judge in the trial of the parties, in particular: a) re-involvement of a judge in the same case between the parties; b) the re-involvement of a judge in the consideration of different cases between the same parties, which may or may not be related. The author analyzes the ECtHR’s approach to determining whether or not there is objective doubt in the impartiality of the judge in each of these groups of cases. On the basis of the above, it is concluded that only the re-participation of a judge, who delivered judgment in lower court, in proceedings in courts of higher instances is considered to be an absolute ground for disqualification of a judge. Instead, all other situations involving a judge’s repeated involvement in the same case do not automatically indicate the lack of the court impartiality and do not preclude a judge’s repeated participation in proceedings between the parties. In such situations, the specific circumstances of the case must be taken into account to assess the existence of reasonable doubt as to the bias of the judge. In addition, the ECtHR finds a breach of the court’s impartiality requirements in cases of repeated involvement of a judge in related cases involving the same parties, since these situations may raise doubts about the impartiality of the judge from the perspective of an outside observer.
