Єдиний державний реєстр судових рішень як засіб доступу громадян до судових рішень

Abstract

У статті розглянуто систему пошуку судових рішень у Єдиному державному реєстрі судових рішень та деталізовано правила користування ним. Актуальність статті пояснюється необізнаністю громадян щодо можливостей системи пошуку Єдиного державного реєстру судових рішень, у зв’язку з чим вони використовують лише простий метод вводу номеру справи та дати прийняття рішення. Водночас метою статі є характеристика системи пошуку в Єдиному державному реєстрі судових рішень як засобу доступу громадян до судових рішень, а також обґрунтування того, що за допомогою сучасних інструментів можливо прослідкувати зміни в судовій системі, перетворити отримані з Реєстру дані на аналітичні та статистичні дослідження. Зазначено, що за допомогою системи пошуку на основі внесених до Реєстру рішень користувачі мають можливість здійснити різноманітні види аналізу – це і динаміка надходжень справ, і кількість накладених стягнень за їх категоріями, і огляд судової практики. Окреслено потенційні можливості розширеного пошуку в базі даних електронних копій судових рішень. Зазначено, що саме керівник апарату відповідає за повне та правильне внесення до АСДС реєстраційних відомостей по судовій справі. Запропоновано варіанти пошуку необхідної інформації у Єдиному державному реєстрі судових рішень. Зауважено, що основною формою пошуку є пошук по точній фразі, однак пропонуються також інші прийоми. Додатково наголошено на тому, що рішення, з яким особа має можливість ознайомитись в Реєстрі, не вважається таким, що отримане належним чином. Зроблено висновок, що Єдиний державний реєстр судових рішень виступає важливим засобом доступу громадян до судових рішень, адже наявна в ньому інформація є важливим джерелом інформації, що може бути використана для підготовки аналізів, аналітичних і статистичних звітів, узагальнення судової практики. Водночас проведена характеристика системи пошуку в Єдиному державному реєстрі судових рішень доводить, що за допомогою сучасних інструментів можливо прослідкувати зміни в судовій системі, перетворити отримані з вказаного реєстру дані на аналітичні та статистичні дослідження. The article considers the system of search for court decisions in the Unified State Register of Court Decisions and details the rules of its use. The relevance of the article is explained by the ignorance of citizens about the possibilities of the search system of the Unified State Register of Court Decisions, in connection with which they use only a simple method of entering the case number and date of decision. At the same time, the purpose of the article is to characterize the search system in the Unified State Register of Court Decisions as a means of citizens' access to court decisions, as well as to substantiate that modern tools can track changes in the judiciary, turn data obtained from the Register into analytical and statistical studies. It is noted that with the help of the search system, based on the decisions entered in the Register, users have the opportunity to perform various types of analysis - the dynamics of cases, and the number of fines imposed by their categories, and review of case law. The potential possibilities of advanced search in the database of electronic copies of court decisions are outlined. Indicated, that it is the chief of staff who is responsible for the complete and correct entry of registration information on the court case into the TSA. Options for searching for the necessary information in the Unified State Register of Court Decisions are proposed. Noticed, that the main form of search is to search for the exact phrase. however, other techniques are also offered. It is further emphasized that the decision, which the person has the opportunity to get acquainted with in the Register, is not considered to be properly received. It is concluded that the Unified State Register of Judgments is an important means of access of citizens to court decisions, because the information available in it is an important source of information that can be used for analysis, analytical and statistical reports, generalization of judicial practice. At the same time, the description of the search system in the Unified State Register of Court Decisions proves that with the help of modern tools it is possible to trace changes in the judicial system, to turn the data obtained from this register into analytical and statistical studies.
