| Краткий осмотр (реферат): | У статті досліджуються основні проблеми інституційного правового регулювання банківської системи Америки. Проаналізовано етапи банківського регулювання в Америці. Досліджено структурні та функціо- нальні аспекти американської банківської системи. Відзначено наслідки «вільного банкінгу» в американській банківській системі. Виявлено слабкі місця у фінансовій системі Америки. Охарактеризовано наслідки Великої депресії для американської банківської системи. Проаналізовано наслідки діяльності вищеназваних законів для американської банківської діяльності. Встановлено, що розвиток американської банківської сфери, а також будь-які зрушення у фінансових відносинах були зумовлені законодавчо-інституційними перетвореннями в банківській діяльності, які формувалися у процесі історичного розвитку. Досвід здійснення інституційних реформ в американській банківській системі міг би стати корисним для вдосконалення вітчизняної банківської системи. |
| Описание: | The article examines the main problems of institutional legal regulation of the American banking system. The stages of banking regulation in America are analyzed. The structural and functional aspects of the American banking system are studied. The consequences of "free banking" in the American banking system are noted. The peculiarities of the Law on National Banking are highlighted. Weaknesses in the American financial system have been identified. The main features of the Aldrich-Riland Act in the American financial system are studied. The peculiarities of McFadden's Law activity in the American banking system are noted. The consequences of the Great Depression for the American banking system are described. The characteristic features of the Banking Holding Company Act and the International Banking Act in the American financial system are analyzed. The main features of the Law "On Norms of Regulation of Financial Institutions and Interest Rate Control" in the American banking system are noted. The general features of the Law on Depository Institutions (Garn – Saint Germain law) in the American banking system are highlighted. The main problems of the Law on International Credit Supervision have been studied. The characteristic features of the Law "On the Reform of Financial Institutions, Their Recovery and the Application of Coercive Measures" in the American financial system are highlighted. The main features of bank mergers in the American banking system after the entry into force of the Rigle – Neal Act are analyzed. The characteristic features of the Gram-LeachBliley Financial Banking Act are noted. The activity of American banks is described. The consequences of the above laws for American banking are analyzed. It is established that the development of the American banking sector, as well as any changes in financial relations were due to legislative and institutional changes in banking, which were formed in the process of historical development. Therefore, the experience of institutional reforms in the American banking system could be useful for improving the domestic banking system. |
