Abstract: Стаття присвячена розкриттю окремих аспектів розуміння природи евтаназії. Проаналізовано, що незважаючи на різноманітні відтінки щодо визначення сутності поняття «евтаназія», воно передбачає спричинення смерті особи, яка невиліковно хвора та (або) переносить тяжкі фізичні та (або) психологічні страждання, за її свідомим проханням, вчинене з мотивів співчуття до такої особи. Визначено, що традиційно в науці прийнято розрізняти активну та пасивну евтаназію. Якщо активна передбачає дії медичного персоналу щодо приведення людини до смерті, то пасивна – навпаки, відмову від учинення дій, які були б спрямовані на спасіння життя людині. Досліджено, що евтаназія ставить серйозну етичну дилему. З одного боку, зустрічаються люди, які внаслідок невиліковних хвороб втрачають сенс у продовженні власного життя, висловлюючи чесне бажання померти. Інші – співпереживають їх стражданням і поважають їх позицію прийняти смерть. З іншого ж боку, залишається сумнів про те, чи правильно припиняти чиєсь життя за їх проханням та чи не є це вчиненням убивства. У зв’язку з чим виникає потреба у аналізі співвідношення між такими змістовними конфігураціями, як правом на життя (у аспекті свободи розпоряджатись ним) та «обов’язком жити». Окрім того, визначено, що у сфері правової регламентації евтаназії країни світу поділяються за одним критерієм: ставленням держави та суспільства до допустимості її застосування. Залежно від цього держави або дозволяють евтаназію (активну, пасивну чи обидві одразу), або забороняють. У випадку заборони евтаназія визнається кримінально караним діянням, кваліфікуючись як убивство. Дослідники розподіляють країни світу за ставленням до неї на кілька груп. І на сам кінець, зроблено висновок, що проблема реалізації права на евтаназію має місце, перш за все, у аксіологічній (ціннісній) площині, у аспекті розуміння та усвідомлення життя людини як однієї з найвищих загальнолюдських цінностей, що забезпечується і захищається правом. У світлі цього постає питання про те, чи повинна людина до останнього боротись за своє життя, чи може вона припинити його через хворобу, страждання, біль. У будь-якому разі, право на евтаназію безпосередньо стосується (не-) збереження людського життя. Ключові слова: евтаназія, право на життя, право на смерть, обов’язок жити.
The article is devoted to the disclosure of certain aspects of understanding the nature of euthanasia. It is analyzed that despite the various nuances of defining the essence of the concept of “euthanasia”, it involves the death of a person who is terminally ill and (or) suffers severe physical and (or) psychological suffering, at his conscious request, committed out of compassion for such a person. . It is determined that traditionally in science it is accepted to distinguish between active and passive euthanasia. If the active involves the actions of medical personnel to bring a person to death, the passive - on the contrary, the refusal to take actions that would be aimed at saving lives. It has been investigated that euthanasia poses a serious ethical dilemma. On the one hand, there are people who, as a result of incurable diseases, lose meaning in the continuation of their own lives, expressing an honest desire to die. Others - empathize with their suffering and respect their position to accept death. On the other hand, there are still doubts about whether it is right to end someone’s life at their request and whether it is not a murder. Therefore, there is a need to analyze the relationship between such meaningful configurations as the right to life (in terms of freedom to dispose of it) and the “obligation to live”. In addition, it is determined that in the field of legal regulation of euthanasia, the countries of the world are divided by one criterion: the attitude of the state and society to the admissibility of its use. Depending on this, states either allow euthanasia (active, passive or both) or prohibit it. In the case of prohibition, euthanasia is recognized as a criminal offense, qualifying as a murder. Researchers divide the countries of the world according to it into several groups. Finally, it is concluded that the problem of realization of the right to euthanasia takes place, first of all, in the axiological (value) plane, in the aspect of understanding and awareness of human life as one of the highest universal values provided and protected by law. In light of this, the question arises as to whether a person should fight to the last for his life, whether he can stop it due to illness, suffering, pain. In any case, the right to euthanasia is directly related to the (non-) preservation of human life. Key words: euthanasia, right to life, right to die, obligation to live.
