Структура механізму забезпечення права на свободу творчості

Abstract

Унаслідок аналізу статичного виміру механізму забезпечення права на свободу творчості через сукупність скла- дових елементів у статті проаналізовано механізм забезпечення права на свободу творчості. Визначено, що це єд- ність взаємопов’язаних правових та інституційних засобів, загальносоціальних умов, що створюють належні юридичні і фактичні можливості для повноцінного здійснення права на свободу творчості. Доведено, що структура механіз- му забезпечення права на свободу творчості включає гарантії забезпечення права на свободу творчості, державні та недержавні інституційні засоби забезпечення права на свободу творчості, правові засоби забезпечення права на свободу творчості, правосвідомість суб’єктів права у сфері творчих правовідносин. Визначено, що гарантії права на свободу творчості – це система узгоджених соціально-економічних, політичних, культурних (духовних), юридичних передумов, умов, засобів і способів, що забезпечують фактичну реалізацію та захист у разі порушення (оскарження, невизнання). До державних і недержавних інституційних засобів забезпечення права на свободу творчості віднесено такі: а) міжнародні організації, б) органи судової влади, в) організацію поліцейських структур (англ. Police), г) прокура- туру, ґ) омбудсмена, д) інститути громадянського суспільства (громадські організації, релігійні організації, благодійні організації, професійні спілки, творчі спілки, організації роботодавців, недержавні засоби масової інформації). До- ведено, що правові засоби забезпечення права на свободу творчості – це правова ідеологія, принципи права, норми права, правові акти, що регулюють суспільні відносини, юридичні факти, правовідносини у сфері творчості. Проана- лізовано правосвідомість як елемент механізму забезпечення права на свободу творчості. Due to the analysis of the static dimension of the mechanism of ensuring the right to freedom of creativity through a set of constituent elements, the article analyzes the mechanism of ensuring the right to freedom of creativity. It is determined that this is the unity of interconnected legal and institutional means, general social conditions, which create the proper legal and factual opportunities for the full realization of the right to freedom of creativity. It is proved that the structure of the mechanism for ensuring the right to freedom of creativity includes guarantees for the right to freedom of creativity, state and non-state institutional means of securing the right to freedom of creativity, legal means of securing the right to freedom of creativity, fairness of subjects of law in the sphere of creative relationships. It is determined that guarantees of the right to freedom of creativity are a system of harmonized socio-economic, political, cultural (spiritual), legal prerequisites, conditions, means and methods that ensure the actual realization and protection in case of violation (appeal, non-recognition). The state and non-state institutional means of securing the right to freedom of creativity include: a) international organizations, b) judicial authorities, c) organization of police structures, d) prosecutors, e) ombudsman, e) civil society institutions (public organizations) , religious organizations, charities, trade unions, creative unions, employers’ organizations, non-state media). It is proved that the legal means of securing the right to freedom of creativity are legal ideology, principles of law, norms of law, legal acts regulating social relations, legal facts, legal relations in the sphere of creativity. Justice is analyzed as an element of the mechanism of securing the right to freedom of creativity.
