Правові гарантії опозиційної діяльності: досвід Французької Республіки

Abstract

Стаття присвячена аналізу правової регламентації гарантій опозиційної діяльності у Французькій Республіці. Встановлено, що правовий статус опозиції у Французькій Республіці врегульовано на рівні норм Конституції, регла- менту нижньої палати парламенту – Національних Зборів та підзаконними нормативно-правовими актами парла- менту. Приділено увагу конституційно-правовим гарантіям діяльності парламентської опозиції в Національних Збо- рах Франції. Досліджено конституційну процедуру вираження недовіри уряду шляхом прийняття резолюції осуду як можливість опозиції впливу на владу та взаємодію з нею. Встановлено, що відповідно до положень Конституції Французької Республіки, для внесення резолюції осуду досить 58 депутатів Національних Зборів. Проаналізова- но право опозиції на звернення до Конституційної Ради як органу конституційного контролю та право на подання петиції, що полягає у можливості представлення письмових запитів або пропозицій. Визначено, що гарантією опо- зиційної діяльності у Національних Зборах Франції є пропорційне та збалансоване представництво політичних груп у постійних, спеціальних і слідчих комісіях. Акцентовано на тому, що за рішенням кожної палати французького парламенту один день її засідань протягом місяця присвячується розгляду ініціатив опозиційних груп у відповідній палаті, а також груп, які становлять меншість. Звернено увагу на встановлені конституційні та законодавчі запо- біжники для того, щоб опозиційна діяльність у Французькій Республіці була максимально конструктивною. Наведе- но думки українських учених щодо характеристики французької моделі опозиційної діяльності та взаємодії влади й опозиції у Французькій Республіці. Висловлено пропозиції щодо запозичення досвіду Французької Республіки в частині сесійної роботи парламенту – Верховної Ради України. The article is devoted to the analysis of the legal regulation of guarantees of opposition activity in the French Republic. It is established that the legal status of the opposition in the French Republic is regulated at the level of the norms of the Constitution, the regulations of the lower house of parliament – the National Assembly and the by-laws regulations of the parliament. It has been paid the attention paid to the constitutional and legal guarantees of the activities of the parliamentary opposition in the French National Assembly. The constitutional procedure for expressing confidence in the Government was investigated by adopting a condemnation resolution as an opportunity for the opposition to influence and interact with the government. It is established that according to the Constitution of the French Republic, 58 deputies of the National Assembly are sufficient to submit a resolution of condemnation. It has been analyzed the right of the opposition to appeal to the Constitutional Council, as a body of constitutional control, and the right to submit a petition, which is possible to submit written requests or proposals. It is determined that the guarantee of opposition activity in the French National Assembly is the proportional and balanced representation of political groups in the standing, special and investigative commissions. It has been emphasized that at the decision of each chamber of the French Parliament, one day of its meetings, during the month, is devoted to the consideration of the initiatives of the opposition groups in the respective chamber as well as of the minority groups. The attention is drawn to the established constitutional and legislative safeguards to ensure that opposition activities in the French Republic are as constructive as possible. It has been presented the thoughts of Ukrainian scientists regarding the characteristics of the French model of opposition activity and the interaction of power and opposition in the French Republic. Proposals were made regarding the borrowing of the experience of the French Republic in the part of the session work of the Parliament – the Verkhovna Rada of Ukraine.
