Освітній омбудсмен як інституційна гарантія у сфері забезпечення прав людини на освіту

Abstract

У цій статті проаналізовано діяльність освітнього омбудсмена як інституційної гарантії у сфері забезпечення права людини на освіту. В контексті сучасних європейських інтеграційних процесів в Україні, розвитку концепції прав люди- ни, реформування законодавства України, еволюції громадянського суспільства важливим є дослідження проблема- тики освітнього омбудсмена як інституційної гарантії у сфері забезпечення права людини на освіту. Освіта є основою інтелектуального, духовного, фізичного і культурного розвитку особистості, її успішної соціалізації, економічного до- бробуту, запорукою розвитку суспільства, об’єднаного спільними цінностями і культурою, та держави. Натепер питання захисту прав людини в освіті є найактуальнішим для будь-якої демократичної держави. У більшос- ті країн світу є спеціалізовані омбудсмени, повноваження яких повністю чи частково стосуються захисту прав людини у сфері освіти. Роль інституту омбудсмена постійно зростає. На думку автора, слід враховувати той факт, що в державі є окремі групи населення або ж окремі права, реалізація яких для людей і держави має особливе значення, які своєю чергою потребують додаткового захисту. Така потреба призводить до заснування спеціалізованих омбудсменів. Здійснення державної політики співробітництва у сфері захисту прав людини неможливе без налагодження по- зитивного діалогу між громадянами та органами державної влади, зміцнення засад громадянського суспільства, за- безпечення повної відповідності українського законодавства і практики принципам і нормам Європейського Союзу. Освітній омбудсмен має розробити спеціальні заходи для імплементації європейських стандартів захисту прав людини, брати безпосередню участь у цих процесах, посилювати їх на місцевому рівні, підтримувати ідеї спеціалі- зованого представництва певних категорій населення на державному рівні. Освітній омбудсмен є новітньою інституційною гарантією, діяльність якого сприятиме реалізації та захисту по- рушених освітніх прав людини, є своєрідним інструментом наближення прав людини та захисту цих прав до між- народних стандартів. The article is devoted to the problems of Educational Ombudsman as an institutional guarantee in the field of human rights for education. In the context of contemporary European integration processes of Ukraine, the development of the concept of human rights, the reform of the legislation of Ukraine, the evolution of civil society, the need to establish the legal status of Educational Ombudsman, important is to research the problems of the Educational Ombudsman as an institutional guarantee in the field of human rights for education. Education is the basis of the intellectual, spiritual, physical and cultural development of the individual, his successful socialization, economic well-being, the key to the development of a society united by shared values and culture, and the state. Nowadays the issue of the protection of human rights in education is a topical issue for any democratic state. In most countries, there are specialized ombudsmen whose mandate is wholly or partly relevant to the protection of human rights in the field of education. The role of the institute of Ombudsman is constantly growing. According to the author, one should take into account the fact that in the state there are separate population groups or individual rights, the realization of which is of particular importance for people and the state, which in turn need additional protection. Such a need leads to the establishment of specialized ombudsman. Implementation of the state policy of cooperation in the field of human rights protection is impossible without establishing a positive dialogue between citizens and public authorities, strengthening the principles of civil society. The Educational Ombudsman, as a body of state administration of Ukraine, should develop special measures for the implementation of European standards of human rights protection, participate directly in these processes, strengthen them at the local level, and support the ideas of specialized representation of certain categories of population at the state level. The Educational Ombudsman is the new institutional warranty, which activities will help to promote and protect violated educational human rights, and is a kind of instrument for bringing human rights closer and protecting them to international standards.
