Американська модель професійного спорту: особливості конституційно- правового регулювання

Abstract

Поява та інтенсивний розвиток професійного спорту за часів незалежної України вимагають створення злаго- дженого механізму конституційно-правового регулювання цієї сфери суспільних відносин. Відправним пунктом для створення такого механізму повинні стати детальне вивчення та впровадження досвіду зарубіжних країн. Незважа- ючи на велику кількість праць, присвячених дослідженню різних аспектів функціонування професійного спорту на міжнародній арені, необхідно констатувати недостатню вивченість правового складника вказаної сфери діяльності. Метою статті є огляд та аналіз конституційно-правового регулювання американської моделі професійного спор- ту. Досліджено конституції та нормативно-правові акти країн Північної та Південної Америки на предмет правового регулювання фізичної культури і спорту, а саме: Конституцію Бразилії, Конституцію Парагваю, Закон «Про аматор- ський спорт» та Закон «Про трансляції спортивних змагань національними телекомпаніями» (США), Закон «Про спорт» (Бразилія) та інші. Розглянуто питання компетенції органів державної влади та місцевого самоврядування США в цій сфері суспільних відносин. Встановлено, що американська модель професійного спорту суттєво відрізняється від європейської та має свої характерні особливості (високий ступінь децентралізації та незначну участь держави в управлінні фізичною культу- рою і спортом, чіткий поділ спорту на аматорський і професійний, автономію спортивних організацій, комерційний принцип в організації професійного спорту), що знайшло своє відображення в конституціях і відповідних законодав- чих актах країн Північної та Південної Америки. The emergence and intensive development of professional sport in times of independent Ukraine requires the creation of a harmonized mechanism of constitutional and legal regulation of this sphere of public relations. The starting point for the creation of such a mechanism should be a detailed study and implementation of the experience of foreign countries. Despite the large number of works devoted to the study of various aspects of the functioning of professional sport in the international arena, it is necessary to state the insufficient study of the legal component of the specified field of activity. The purpose of the article is to review and analyze the constitutional regulation of the American model of professional sport. The constitutions and regulatory acts of the countries of North and South America concerning the legal regulation of physical culture and sports were studied, namely: the Constitution of Brazil, the Constitution of Paraguay, the Law on Amateur Sport and the Law on the Broadcasting of Sports Competitions by National Television Companies (USA), The Law on Sport (Brazil) and others. The issue of competence of the state authorities and local self-government of the USA in this sphere of public relations is considered. It is established that the American model of professional sport is significantly different from the European one and has its characteristic features (high degree of decentralization and low state participation in the management of physical culture and sports, a clear division of sports into amateur and professional, autonomy of sports organizations, commercial principle in the organization of professional sports), which was reflected in the constitutions and relevant legislation of the Americas.
