Інституційні механізми захисту права людини на репродуктивне відтворення

Abstract

Законодавче закріплення прав і свобод людини у репродуктивній сфері ще не забезпечує їхній безумовний за- хист. Держава повинна впровадити через державний примус та через систему державних і недержавних органів як гарантування цих прав і свобод, так і їх охорону та захист. Стаття присвячена інституційним механізмам захисту права людини на репродуктивне відтворення. Вказується на важливість створення ефективної системи уповноважених органів для захисту прав людини у репродуктивній сфері. Досліджено місце центральних органів державної влади, таких як парламент, уряд, спеціальні органи державної влади, не тільки у формуванні національної репродуктивної політики, але й у створенні гарантій і механізмів захис- ту права людини на репродуктивне відтворення. На досвіді різних держав виділено особливе значення спеціальних державних органів і установ, у компетенцію яких віднесено окремі питання захисту прав людини в цій сфері. Крім того, звернуто увагу на роль місцевих органів державної влади та органів самоврядування в інституцій- ному механізмі захисту прав людини у репродуктивній сфері. Наголошено на їхньому значенні під час вирішення регіональних проблем у цій проблематиці, зокрема, шляхом створення відповідних регіональних програм та їх фінансування. Особливу ланку інституційного механізму становлять правоохоронні органи та суди. Саме на них покладається основне навантаження в захисті оспорюваних чи порушених прав людини у репродуктивній сфері. У будь-якій державі вагомим чинником у інституційному механізмі захисту є також неурядові організації, профе- сійні асоціації, які, ґрунтуючись на нормах закону, створюють власні етичні приписи і правила поведінки, зокрема, під час лікування допоміжними репродуктивними технологіями. Досліджено роль міжнародних органів. Розкрито вагоме значення Організації Об’єднаних Націй, міжнародних судів та інституцій, Всесвітньої організації охорони здоров’я у розвитку правової політики у репродуктивній сфері. Підкреслено вплив із досліджуваного питання міжнародних неурядових організацій, зокрема Всесвітньої медич- ної асоціації. Legislative protection of human rights and freedoms in the reproductive field does not yet ensure their unconditional protection. A state must implement, through the state coercion and through the system of the state and non-state bodies, both should guarantee these rights and freedoms, as well as their protection and defense. This article is focusing on institutional mechanisms of the protection of the human rights for reproduction. The importance of creating an effective system of authorities for the protection of human rights in the reproductive field was emphasized. The place of central state authorities, such as parliament, government and special bodies of state power, was investigated not only in a formulation of national reproductive policies but also in the formation of guarantees and mechanisms for the protection of human rights for reproduction. The experience of different states emphasizes the special importance of the special state of bodies and institutions, which have specific experience of human rights protection. In addition, attention has been paid to the role of the local government and self-government bodies in the institutional mechanism of human rights protection in the reproductive field. They are emphasizing their importance in solving regional problems in this area, in particular by creating and supporting regional programs. A special element of the institutional mechanism is law enforcement agencies and courts. They place the brunt of protecting the impacted or affected human rights in the reproductive field. In any state, non-governmental organizations, professional associations, which, based on directions of the law, create their own ethical instructions and rules of conduct, including the guidelines associated with reproductive technologies. It is a significant factor in the institutional protection’s mechanism. The role of international bodies has been investigated. The important role of the United Nations, international courts, institutions and the World Health Organization in the development of legal policy in the reproductive field has been revealed. The role of the researched issue of international non-governmental organizations, in particular, the World Medical Association is emphasized. The role of international bodies has been investigated.
