Сутнісні ознаки принципів сімейного права

Abstract

Стаття присвячена висвітленню теоретичних аспектів сутнісних ознак принципів сімейного права. Проаналізо- вано підходи різних вчених щодо розуміння ознак принципів права, їх порівняння з правовою нормою. Обґрунтова- но, що принципи права формуються не зверху, тобто при їх законодавчому закріпленні, а знизу під час узгодження людьми своєї поведінки. Встановлено, що принцип є стандартом, якого слід дотримуватися на стільки, на скільки він виражає справедливість, правильності чи будь-який інший моральний вимір, що сприяє його легітимації. У статті обґрунтовано, що принципи сімейного права є такими правовими явищами, які пов’язують зміст сімей- ного права із тими закономірностями суспільного життя, на яких воно будується і які воно водночас закріплює. Зміст принципів сімейного права багато в чому визначається суспільним світоглядом, пануючими культурними, мораль- ними та релігійними цінностями, а також тісно пов’язаний із буттям людини. Доведено, що при дослідженні сутнісних ознак принципів сімейного права їх можна порівняти з нормами сі- мейного права. У цьому аспекті запропоновано виділити дві групи сутнісних ознак: 1) ознаки принципів сімейно- го права, що є характерними і для норм сімейного права (загальнообов’язковий характер, загальний характер, обумовленість сімейними відносинами, регулятивність); 2) сутнісні ознаки принципів сімейного права, що відо- бражають відмінність між нормами та принципами сімейного права (імперативність, стабільність, більший ступінь об’єктивності, у порівнянні з нормами сімейного права, високий рівень узагальненості, ширші за змістом, аніж сі- мейно-правові норми, ціннісна-орієнтованість, системність, пріоритетність щодо норм сімейного прав). Така ознака, як нормативність, є дискусійною. Оскільки принципи права не обов’язково повинні бути норматив- но визначені, вони можуть випливати із змісту та суті права. Обґрунтовано, що сімейно-правові принципи є ближчі до людського буття і в силу цього вони є первинними щодо норм сімейного права, мають фундаментальне значення, виражають сутність сімейного права. The article deals with the theoretical aspects of the essential features of the principles of family law. The approaches of different scientists to understanding the features of the principles of law, their comparison with the legal norm are analyzed. It is justified that the principles of law are formed not from above, that is, when they are enshrined in law, but from below when people agree on their behavior. It has been established that the principle is a standard that should be respected insofar as it expresses justice, correctness or any other moral dimension that contributes to its legitimation. The article argues that the principles of family law are such legal phenomena that link the content of family law with those laws of social life on which it is based and which it simultaneously consolidates. The content of the principles of family law is largely determined by the public outlook, the prevailing cultural, moral and religious values, and is also closely linked to human existence. It is proved that in the study of the essential features of the principles of family law, they can be compared with the rules of family law. In this aspect, it is proposed to distinguish two groups of essential features: 1) features of the principles of family law, which are also characteristic of the rules of family law (mandatory, general, conditioned by family relations, regulatory); 2) essential features of the principles of family law, which reflect the difference between the rules and principles of family law (imperativeness, stability, greater degree of objectivity in comparison with the rules of family law, a high level of generalization, wider in content than family law values, value – orientation, systematicity, priority over family law norms). Such a sign as normative is debatable. Since the principles of law do not need to be statutory, they may derive from the substance and substance of the law. It is substantiated that family law principles are closer to human existence and therefore they are primary in relation to the rules of family law, are fundamental, express the essence of family law.
