Abstract: | Поняття «шаріат» та «фікх» є невіддільними складниками мусульманського права, що було відображено й підтверджено в результа-
тах досліджень багатьох поколінь державознавців. Різноманіття поглядів стосовно дефініції та змісту на сучасному етапі розвитку юри-
дичної науки свідчить про гносеологічну проблемність та актуальність цього питання. У статті пізнання зазначеного державно-правового
явища здійснено через призму релігійних настанов та порівнянь задля того, щоб підтвердити єдність мусульманського права та релігії.
Ключові слова: мусульманське право, іслам, шаріат, фікх, Коран. The concepts “Shariat” and “Fiqh” is an integral part of Islamic law, which was reflected and confirmed as a result of the research of many generations of state officials. The diversity of views on the definition and content at the stage of modern development of legal science indicates the epistemological problematics and the relevance of this issue. In the article, the knowledge of this state-legal phenomenon is carried out through the prism of religious instructions and comparisons in order to confirm the unity of Muslim law and religion.
