Abstract: Історія мораторію на відчуження земель сільськогосподарського призначення розпочалася водночас із запровадженням права приватної власності на землю, Верховна Рада України неодноразово, зазвичай конституційною більшістю голосів продовжувала його дію. Так, 18 січня 2001 року ухвалений Закон України «Про угоди щодо відчуження земельної частки (паю)», який запровадив мораторій; під час ухвалення Земельного кодексу України від 25 жовтня 2001 року мораторій був відтворений і розширений. Як відомо, надалі мораторій практично став безстроковим, оскільки його зняття пов’язувалося з ухваленням закону про ринок земель. Протягом дев’ятнадцяти років власники земель сільськогосподарського призначення були позбавлені права вільно розпоряджатися своїм майном. У 2018 році Європейський суд з прав людини визнав, що мораторій порушує права власників (справа «Зеленчук і Цицюра проти України» (заяви № № 846/16, 1075/16)). Зі спливом дев’ятнадцяти років дії мораторію нинішній уряд, ураховуючи теперішні економічні реалії, вдався до активних дій, що спрямовані на зняття мораторію, у результаті чого у другому читанні парламент ухвалив Закон України «Про внесення змін до деяких законодавчих актів України щодо обігу земель сільськогосподарського призначення». На думку авторів, дані нововведення є позитив- ними та сприятимуть розвитку аграрного сектора й економіки України загалом. Передусім позитивним є те, що власники паїв нарешті отримають права власників у повному обсязі, що передбачено статтею 41 Конституції України (з липня 2021 року). Встановлено, що нео- днозначність сприйняття суспільством ідеї лібералізації базових засад розвитку земельного ринку стримує формування ринку земель сільськогосподарського призначення. Запропоновано практичні рекомендації для вирішення проблемних аспектів запровадження та розвитку ринку земель сільськогосподарського призначення, які передбачають попереднє формування відповідного економіко-право- вого середовища, що дасть змогу нівелювати негативні соціально-економічні наслідки лібералізації земельних відносин і сформувати сприятливий інвестиційний клімат для залучення фінансових ресурсів у сферу аграрного виробництва. The history of the moratorium on the alienation of agricultural and began simultaneously with the introduction of land private-property rights, and the Verkhovna Rada of Ukraine has repeatedly, as a rule, continued its validity by constitutional majority vote. Hence, January 18, 2001, the Law of Ukraine “On Agreements on the Alienation of Land Partition (Share)” was adopted, which introduced the moratorium; as the Land Code of Ukraine was adopted on October 25, 2001, the moratorium was restored and extended. It is known that in the future the moratorium virtually became indefinite, since its removal was connected with the adoption of the law on the land market. For 19 years, landowners of agricultural and were denied the right to freely dispose of their property. In 2018, the European Court of Human Rights found that the moratorium violated the rights of owners (“Zelenchuk and Tsytsyura v. Ukraine” (applications № № 846/16, 1075/16)). As the 19-year moratorium is to expire, the current government, taking into account the current economic realities, has taken active action aimed at lifting the moratorium, which resulted in the Parliament adopting in the second reading in the whole the Law of Ukraine “On Amendments to Some Legislative Acts of Ukraine on Circulation of Agricultural Land”. The authors believe that these innovations are definitely positive and will contribute to the development of the agricultural sector and the economy of Ukraine as a whole. First of all, the positive thing is that owners of shares will finally receive the rights of owners in full, as provided for in Article 41 of the Constitution of Ukraine (since July 2021). It is established that ambiguous perception of the idea of liberalization of the basic principles of the land market development by the society hinders the formation of the agricultural land market. Practical recommendations are offered to address the problematic aspects of introduction and development of the agricultural land market, which provide for preliminary formation of appropriate economic and legal environment, which will help to offset negative socio-economic consequences of the liberalization of land relations and create a favorable investment climate for attracting financial resources to the agricultural sector.
