Гарантії реалізації адміністративно-правового статусу Національного антикорупційного бюро України

Abstract

У статті на основі аналізу наукових поглядів учених та норм чинного законодавства України надано характеристику гарантіям реа- лізації адміністративно-правового статусу Національного антикорупційного бюро України. Зазначено, що специфіку кадрового забез- печення Національного Антикорупційного бюро України можна віднести до юридичних гарантій, що проявляється в особливому порядку конкурсного відбору Директора Національного бюро та у вичерпному переліку підстав припинення повноважень Директора Національ- ного бюро, які визначені цим Законом, а також у конкурсних засадах відбору інших працівників Національного бюро. Визначено, що гарантії реалізації адміністративно-правового статусу Національного антикорупційного бюро України засновані на забезпеченні неза- лежності цього органу шляхом упровадження ідеологічних, економічних, організаційних, кадрових та інших умов та засобів, які створені чинним законодавством для забезпечення ефективного виконання завдань з попередження, виявлення, припинення, розслідування та розкриття корупційних правопорушень зазначеним органом, а також запобігання вчиненню нових. Зроблено висновок, що гарантії реалі- зації адміністративно-правового статусу Національного антикорупційного бюро можна поділити на певні різновиди, зокрема: за сферою впливу: на юридичні (які включають у себе організаційно-правові, кадрові, гарантії із забезпечення безпеки та ін.), економічні, соціальні, ідеологічні (морально-духовні), політичні тощо; за специфікою правового статусу: гарантії, що властиві працівникам Бюро як державним службовцям (загальні), і ті, що забезпечують їхній особливий правовий статус як працівників органу, що здійснює боротьбу з корупцією і має особливий рівень впливу на життя держави; за напрямом впливу на працівників Бюро: позитивні, які стосуються створення особли- вих економічних, соціальних та інших умов забезпечення їхньої незалежності, та негативні, пов’язані з попередженням порушення ними встановлених обов’язків шляхом запровадження їх відповідальності, а також шляхом забезпечення діяльності підрозділів внутрішнього контролю тощо. In the article based on the analysis of scientific views of scientists and norms of the current legislation of Ukraine the characteristic of guarantees of realization of administrative and legal status of the National Anti-Corruption Bureau of Ukraine is given. It is stated that the specific staffing of the National Anti-Corruption Bureau of Ukraine can be attributed to legal guarantees, which is manifested in the special procedure of competitive selection of the Director of the National Bureau and an exhaustive list of grounds for termination of the powers of the Director of the National Bureau, which are defined by this Law, as well as other competitive procedures. It is determined that the guarantees of realization of the administrative and legal status of the National Anti-Corruption Bureau of Ukraine are based on ensuring the independence of this body by introducing ideological, economic, organizational, personnel and other conditions and means created by the current legislation to ensure the effective fulfillment of tasks of prevention, detection, termination, investigation and disclosure of corruption offenses by the specified body, as well as prevention of committing new ones. It is concluded that the guarantees for the implementation of the administrative and legal status of the National Anti-Corruption Bureau can be divided into certain varieties, in particular: by sphere of influence: legal (which includes organizational, legal, personnel, security guarantees, etc.), economic, social, ideological (moral-spiritual), political, etc.; the specificity of the legal status: guarantees inherent in the employees of the Bureau as public servants (general) and those that guarantee their special legal status as employees of a body that fights corruption, which has a special level of impact on the life of the state; by direction of influence on the employees of the Bureau: positive, concerning the creation of special economic, social and other conditions for ensuring their independence and negative, related to the prevention of breach of their assigned duties by imposing their responsibility, as well as by ensuring the activity of internal control units etc. Key words: guarantees, implementation, administrative and legal status, National Anti-Corruption Bureau.
