Історія становлення інституту примусового виконання рішень у цивільних справах

Abstract

У статті досліджено генезу інституту примусового виконання рішень у цивільних справах. Розглянуто періодизацію вказаного інститу- ту на основі досягнень вітчизняного процесуального права. Проаналізовано нормативно-правову базу інституту примусового виконання рішень радянського та періоду незалежної України. Звертається увага на доцільність введення інституту судових виконавців. Ключові слова: примусове виконання, рішення суду, цивільне судочинство, виконавче провадження, виконання рішень суду.

The article examines the genesis of the instituteёs development of the compulsory enforcement of decisions in civil cases. The author considered the periodization of the specified institution on the basis of the achievements of the domestic procedural law. The author analyzed the regulatory framework of the institution of the enforcement of decisions of the Soviet and independent Ukraine period. Attention is drawn to the feasibility of introducing the institution of bailiffs.
