Публічні закупівлі для розвитку інновацій як засіб підвищення якості життя в Україні: аналіз зарубіжного досвіду

Abstract

Стаття присвячена проведенню аналізу зарубіжного досвіду, зокрема країн-членів Угоди СОТ про державні за- купівлі (країн Європейського Союзу, Кореї та Канади), учасницею якої Україна стала у 2016 р., зі стимулювання розвитку інновацій за допомогою публічних закупівель. У статті встановлено, що більшість країн ЄС розглядають публічні закупівлі в якості засобу для стимулювання та розвитку інновацій шляхом закріплення на законодавчому рівні спеціальних процедур для спрощення закупівель інновацій та визначення важливої ролі закупівель у страте- гічних документах з інноваційного розвитку економіки. У цьому контексті окрему увагу було приділено перед-ко- мерційним закупівлям та процедурі інноваційного партнерства. Детально розглянуто досвід Нідерландів та Велико- британії у реалізації програм зі здійснення перед-комерційних закупівель для підтримки суб’єктів господарювання у розробці інновацій. Виявлено, що особливість таких програм у ЄС полягає у тому, що вони здійснюються за пра- вилами перед-комерційних публічних закупівель, як вони визначені у ЄС, і не охоплюються детальними правилами Директив ЄС про публічні закупівлі та Угодою СОТ про державні закупівлі, що дозволяє встановлювати обмеження щодо участі у таких закупівлях лише суб’єктами господарювання з ЄС. Проаналізовано досвід закупівель інновацій Кореї та Канада, які проводять активну підтримку малих та середніх підприємств під час здійснення закупівель інновацій шляхом встановлення преференцій, що обумовлено закріпленням даними країнами виключень з-під дії Угоди СОТ про державні закупівлі. На основі зарубіжного досвіду обґрунтовано шляхи стратегічного використання публічних закупівель для розвитку інновацій в України. The present article is dedicated to the analysis of foreign experience in stimulating the development of innovation through public procurement. Special consideration is given to public procurement for innovations of the member states of the WTO Agreement on Government Procurement (the European Union, Korea and Canada). The author comes to the conclusion that the EU countries consider public procurement as a tool for stimulating and developing innovation by enshrining specific procedures for facilitating procurement for innovations at the legislative level and by defining the important role of public procurement in strategic documents on innovative economic development. In this context, special consideration is given to pre-commercial procurement and the innovation partnership procedure. The article deals with the experience of the Netherlands and the UK in implementing pre-commercial procurement programs to support economic operators in developing innovations. The author emphasizes the fact that such EU programs are based on pre-commercial public procurement which is not covered by the EU Public Procurement Directives and the WTO Agreement on Government Procurement, which allows to restrict the participation in public procurement only to the EU economic operators. The article is dedicated to the experience of public procurement for innovations in Korea and Canada, which actively support small and medium-sized enterprises during the procurement of innovations through the establishment of preferences, based on the exemptions from coverage of the WTO Agreement on Government Procurement. Based on foreign experience the author suggests the ways for strategic use of public procurement for the development of innovations in Ukraine.
